1. Introduction
These Terms and Conditions govern the use of the AWiiDA Interiors website, online shop, products, services, consultations, quotations, orders, deliveries, installations and project-related work.
By accessing this website, submitting an enquiry, requesting a quotation, booking a consultation, placing an order, making payment, approving a design, accepting delivery, allowing installation to begin, or using any AWiiDA Interiors product or service, you agree to be bound by these Terms and Conditions.
These Terms and Conditions apply to all customers, clients, website users, online shop users, businesses, homeowners, guesthouse owners, hospitality clients, office clients, trade clients and any person or entity dealing with AWiiDA Interiors.
If you do not agree with these Terms and Conditions, you must not use this website, place an order, approve a quotation, request services or proceed with any transaction with AWiiDA Interiors.
2. Definitions
In these Terms and Conditions, unless the context indicates otherwise:
“AWiiDA Interiors”, “AWiiDA”, “we”, “us” or “our” means AWiiDA Interiors, its owners, employees, representatives, contractors, installers, agents and authorised service providers.
“Client”, “customer”, “you” or “your” means any person, business, juristic person, organisation or representative who uses the website, makes an enquiry, requests a quotation, places an order, books a consultation, purchases goods, or uses AWiiDA’s services.
“Website” means awiidainteriors.co.za and any related online platform operated by AWiiDA Interiors.
“Goods” or “products” means any item sold, supplied, sourced, manufactured, ordered, installed or delivered by AWiiDA Interiors, including but not limited to curtains, blinds, shutters, roman blinds, curtain tracks, curtain rods, wallpaper, furniture, décor, rugs, mirrors, wall art, upholstery fabric, bed linen, soft furnishings, décor accessories and supplier products.
“Services” means all services offered by AWiiDA Interiors, including but not limited to interior consultations, décor consultations, room refreshes, custom curtain services, blinds, shutters, wallpaper installation, upholstery, furniture and décor sourcing, project management, installations, measuring, styling, design guidance, moodboards, 2D layouts, guesthouse interiors, office interiors and related support.
“Custom-made goods” means goods manufactured, altered, cut, ordered, procured, personalised, imported, sourced or produced according to the client’s measurements, specifications, selected fabrics, selected finishes, colours, sizes, designs, installation requirements or project brief.
“Special-order goods” has the meaning given to it in the Consumer Protection Act and includes goods that AWiiDA is required or expected to procure, create or alter specifically to satisfy the client’s requirements. The CPA defines special-order goods as goods procured, created or altered specifically to satisfy the consumer’s requirements.
“Supplier” means any third-party manufacturer, importer, distributor, fabric house, wallpaper supplier, décor supplier, furniture supplier, hardware supplier, installer, contractor, courier, logistics provider or service provider used by AWiiDA Interiors.
“Quotation” means a written estimate, proposal, invoice, quote or project cost supplied by AWiiDA Interiors.
“Order” means any accepted quotation, online purchase, approved product selection, signed project approval, payment, deposit payment or instruction to proceed.
“Installation” means the fitting, application, hanging, placement, mounting, assembly, adjustment or installation of goods at the client’s premises or nominated address.
3. Legal Compliance
These Terms and Conditions are intended to operate within the laws of South Africa, including but not limited to:
The Consumer Protection Act 68 of 2008;
The Electronic Communications and Transactions Act 25 of 2002;
The Protection of Personal Information Act 4 of 2013;
The common law of contract;
Any other applicable South African legislation.
Nothing in these Terms and Conditions is intended to unlawfully limit, exclude or remove any consumer right that may not legally be limited, excluded or removed.
If any clause is found to be invalid, unlawful or unenforceable, the remaining clauses will remain valid and enforceable to the fullest extent permitted by law.
4. Website Use
The AWiiDA Interiors website is provided for general information, enquiries, online shopping, service descriptions, inspiration and communication.
You agree not to:
Use the website for unlawful purposes;
Interfere with website security or functionality;
Attempt to access private website areas, accounts or systems without permission;
Upload viruses, malware or harmful code;
Copy, scrape, reproduce or misuse website content;
Misrepresent your identity or provide false information;
Use the website in a way that may damage AWiiDA Interiors, its reputation, its systems or its customers.
AWiiDA Interiors may update, suspend, remove or change any website content, product listing, pricing, service description, image, layout or feature at any time without prior notice.
5. Website Information and Accuracy
AWiiDA Interiors takes reasonable steps to ensure that website information is accurate and up to date. However, website content is provided for general information and may not always reflect current availability, pricing, supplier stock, product changes, manufacturing timelines or service availability.
Images on the website are for illustration, inspiration and marketing purposes. Actual products, fabrics, textures, colours, patterns, finishes, sizes, proportions and installation results may differ from website images due to lighting, screen settings, supplier variation, manufacturing processes, dye lots, natural material differences and site conditions.
The client must not rely solely on website images when making final product decisions. Final selections must be confirmed through samples, specifications, written quotations, supplier information or written approval where applicable.
6. Services Covered by These Terms
These Terms and Conditions apply to all AWiiDA Interiors services, including but not limited to:
Interior design consultations;
Mini-reno room refreshes;
Custom-made curtains;
Roman blinds and soft furnishings;
Blinds and shutters;
Motorised blinds and curtain tracks;
Wallpaper supply and installation;
Upholstery and re-upholstery;
Fabric, product and finish selection;
Furniture and décor sourcing;
Office furniture and workspace interiors;
Rugs, mirrors, wall art and décor styling;
Bedroom styling, linen and soft finishes;
Curtain tracks, rods and accessories;
Installation and final styling;
Project management for interior updates;
Guesthouse and hospitality interiors;
2D layouts, moodboards and room concepts;
Home staging and property styling;
Online shop purchases;
Any related product sourcing, delivery, installation, consultation or project work.
7. Consultations
Consultations may take place in person, at the showroom, on site, by telephone, by video call, by WhatsApp, by email, or by another agreed communication method.
Consultations may include general advice, measurements, fabric guidance, product recommendations, styling suggestions, room direction, moodboard direction, supplier discussion or project planning.
Unless expressly agreed in writing, a consultation does not include:
Full technical drawings;
Architectural drawings;
Construction drawings;
Engineering advice;
Electrical plans;
Plumbing plans;
Structural advice;
Detailed procurement schedules;
Full 3D renders;
Unlimited revisions;
Final product ordering;
Installation;
Project management;
Any deliverable not specifically included in the quotation.
Consultation fees are charged for professional time, experience, preparation, travel where applicable and advice. Consultation fees are payable regardless of whether the client proceeds with products, services or a project.
Consultation fees are non-refundable once the consultation has taken place or once AWiiDA has allocated time, prepared for the consultation or travelled for the consultation.
If a consultation is cancelled or postponed by the client, AWiiDA may charge a reasonable cancellation fee, travel fee or rescheduling fee, depending on the notice given and costs already incurred.
8. Site Visits and Measurements
Where required, AWiiDA may conduct site visits for measuring, inspection, consultation or project assessment.
The client must ensure that:
The premises are accessible at the agreed time;
An authorised person is present;
The area is safe to access;
Windows, walls, floors, ceilings and installation areas are clear where possible;
Existing furniture, décor or obstructions are moved if requested;
Any known defects, damp, leaks, cracks, structural issues, uneven walls, electrical issues or previous installation problems are disclosed before measuring or installation.
Measurements are taken according to the visible and accessible site conditions at the time. AWiiDA will not be liable for measurement issues caused by later changes to the site, building movement, renovations, construction work, altered floors, altered ceilings, altered wall finishes, changed window frames, changed skirtings, moved furniture, or any undisclosed site condition.
If the client supplies measurements, AWiiDA is entitled to rely on those measurements. AWiiDA is not responsible for incorrect client-supplied measurements, and any remake, alteration, additional fabric, additional manufacturing, additional installation, courier or supplier cost resulting from incorrect client-supplied measurements will be for the client’s account.
9. Quotations
All quotations are based on the information available to AWiiDA at the time of quoting.
A quotation may include products, fabrics, labour, installation, delivery, supplier charges, travel, project management, design time, manufacturing or other services, depending on the scope.
Unless stated otherwise, quotations are valid for 7 calendar days from date of issue. AWiiDA may amend or withdraw a quotation before acceptance if supplier pricing, stock, exchange rates, transport costs, labour costs, material costs or project information changes.
Quotations may exclude items not expressly stated, including but not limited to:
Electrical work;
Structural work;
Building work;
Painting;
Repairs;
Wall preparation;
Damp treatment;
Removal of old fittings;
Waste removal;
Travel outside the agreed area;
After-hours work;
Additional site visits;
Additional revisions;
Additional samples;
Scaffolding;
Special equipment;
Parking fees;
Courier surcharges;
Storage fees;
Accommodation for out-of-town projects;
Any work not expressly included.
It is the client’s responsibility to check the quotation carefully before approval, including product descriptions, quantities, sizes, colours, fabric names, wallpaper names, finishes, room names, installation addresses, prices and exclusions.
Approval of a quotation means the client accepts the quotation, these Terms and Conditions, and the project scope.
10. Deposits and Payment Terms
AWiiDA may require a deposit before ordering products, booking manufacturing, reserving installation dates, sourcing goods, commencing design work or starting any project.
Unless otherwise agreed in writing:
Custom-made goods, special-order goods, supplier-order goods and project work require a deposit before work begins;
No goods will be ordered until the required deposit has cleared;
No manufacturing will begin until the required deposit has cleared;
No installation will be scheduled until required payments are up to date;
Final payment must be made before or on delivery, before or on installation, or as stated in the quotation or invoice.
AWiiDA may require full payment upfront for online shop purchases, supplier-order goods, custom goods, décor items, sale items, special orders, clearance items, once-off items, imported items or items with limited supplier availability.
Ownership of goods remains with AWiiDA Interiors until all amounts owed by the client are paid in full.
AWiiDA may withhold delivery, installation, release of goods, handover, project files, design deliverables or further work until payment has been received in full.
Payments must be made using AWiiDA’s approved payment methods. Proof of payment does not constitute payment unless the funds reflect in AWiiDA’s nominated bank account.
11. Late Payments and Debt Collection
If the client fails to pay any amount by the due date, AWiiDA may:
Suspend services;
Pause ordering;
Pause manufacturing;
Pause installation;
Withhold goods;
Cancel supplier orders where possible;
Charge interest where legally permitted;
Charge storage fees;
Recover reasonable collection costs;
Refer the account for legal collection;
Exercise any other legal remedy available.
The client will be liable for all reasonable costs incurred by AWiiDA in recovering overdue amounts, including attorney fees, collection fees, tracing fees and administrative costs, to the extent permitted by law.
12. Custom-Made and Special-Order Goods
Many AWiiDA products are custom-made or special-order goods. These may include curtains, roman blinds, upholstered items, wallpaper ordered for a specific project, shutters, blinds, curtain tracks, rods, customised furniture, selected fabrics, special décor items, made-to-measure goods, cut fabric, cut wallpaper, altered items, imported goods and supplier goods ordered specifically for the client.
Once a custom-made or special-order item has been approved and ordered, it may not be cancelled, returned or refunded simply because the client changed their mind, selected the wrong colour, no longer likes the product, changed the room design, changed address, no longer needs the item, found another supplier, or made an incorrect selection.
This does not remove any legal rights the client may have if goods are defective, unsafe or not in accordance with the approved order.
Under the ECTA, the seven-day electronic transaction cooling-off right does not apply to goods made to the consumer’s specifications, clearly personalised goods, or goods that by their nature cannot be returned.
Under the CPA, cancellation rights for advance orders do not apply in respect of special-order goods.
13. Product Samples, Fabric Variations and Dye Lots
Samples are provided to assist with product selection. However, samples may vary from final supplied products due to dye lots, print runs, manufacturing changes, natural material variations, fabric direction, lighting, screen display, scale, texture, batch differences or supplier updates.
The client accepts that:
Fabric batches may vary slightly from samples;
Wallpaper batches may vary slightly from samples;
Wood, stone, leather, woven goods, natural fibres and handmade items may show natural variation;
Printed patterns may vary depending on repeat, cut and placement;
Colours may appear different under different lighting conditions;
Product images and showroom samples may not be exact representations of final goods.
Where batch consistency is important, the client must raise this before ordering. AWiiDA will take reasonable steps to order from the same batch where possible but cannot guarantee supplier batch availability unless confirmed in writing.
14. Fabric, Wallpaper and Material Suitability
AWiiDA may provide guidance on fabric, wallpaper, upholstery, blinds, shutters, curtains, linings and finishes, but final approval remains the client’s responsibility unless otherwise agreed in writing.
The client must consider:
Sun exposure;
Moisture;
Humidity;
Pets;
Children;
Commercial use;
Guesthouse use;
Cleaning requirements;
Durability;
Fire regulations where applicable;
Colour fastness;
Pattern scale;
Texture;
Maintenance;
Suitability for the intended environment.
Some fabrics may fade, shrink, stretch, crease, pill, fray, watermark, stain or react to sunlight, moisture, cleaning products or wear over time. Some wallpaper may not be suitable for damp, uneven, poorly prepared or high-moisture walls. Some furniture and décor items may not be suitable for heavy commercial use.
AWiiDA will not be liable for ordinary wear and tear, misuse, environmental damage, sun fading, damp damage, cleaning damage, pet damage, child damage, fire damage, water damage, mould, insect damage or deterioration caused by site conditions outside AWiiDA’s control.
15. Curtains, Blinds, Shutters and Window Treatments
Curtains, blinds, shutters, roman blinds, tracks, rods and related products are measured, manufactured and installed according to the agreed quotation, site conditions and product specifications.
The client accepts that:
Handmade and fabric-based products may have slight tolerances;
Curtains may settle after hanging;
Fabric may stretch or relax over time;
Lining may behave differently from face fabric;
Pattern placement may differ depending on fabric width and repeat;
Roman blinds may show fold lines or fabric behaviour;
Blinds and shutters may have small light gaps;
Blackout products reduce light but may not create complete darkness unless specifically designed and installed for that purpose;
Window frames, floors, ceilings and walls may not be perfectly level;
Uneven walls or ceilings may affect the final appearance;
Motorised systems may require power, programming, maintenance and supplier support.
Any required electrical work for motorised products must be performed by a qualified electrician and is not included unless expressly stated.
AWiiDA will not be liable for defects caused by incorrect use, force, pulling, tampering, electrical issues, power surges, moisture, incorrect cleaning, failure to maintain tracks or mechanisms, or unauthorised repairs.
16. Wallpaper Supply and Installation
Wallpaper installation requires suitable wall conditions. The client is responsible for ensuring that walls are properly prepared unless wall preparation is expressly included in the quotation.
Walls must be clean, dry, smooth, sound, stable, free of damp, free of mould, free of flaking paint, free of dust, and suitable for wallpaper adhesion.
AWiiDA may recommend wall preparation, but unless expressly included, AWiiDA is not responsible for painting, skimming, damp repair, plaster repair, crack repair, waterproofing or structural correction.
The client accepts that wallpaper results may be affected by:
Damp;
Uneven plaster;
Poor paint quality;
Old adhesive;
Wall movement;
Cracks;
Humidity;
Direct sunlight;
Poor ventilation;
Incorrect cleaning;
Supplier batch variation;
Pattern repeat and matching requirements.
Wallpaper ordered for a specific project is usually a special-order product and cannot be returned if the client changes their mind, unless defective or otherwise required by law.
17. Upholstery and Re-Upholstery
Upholstery work may include recovering, repairing, re-padding, modifying or updating chairs, sofas, benches, headboards and other furniture.
The client accepts that re-upholstery depends on the condition of the existing frame, foam, springs, webbing, stitching, previous workmanship, fabric selected and structure of the item.
Unless expressly stated, upholstery quotations may exclude:
Frame repairs;
Spring replacement;
Foam replacement;
Wood repairs;
Structural repairs;
Collection and delivery;
Fabric protection;
Additional trims;
Unexpected internal damage discovered after opening the item.
If additional issues are discovered after work begins, AWiiDA may issue an additional quotation. Work may pause until the client approves the additional cost.
AWiiDA is not liable for pre-existing defects, weak frames, old foam, hidden damage, woodworm, water damage, previous poor workmanship or structural issues not visible before work began.
18. Furniture, Décor, Rugs, Mirrors, Wall Art and Bed Linen
Furniture, décor, rugs, mirrors, wall art, bed linen and accessories may be sourced from third-party suppliers or available through AWiiDA’s showroom, online shop or supplier catalogues.
Availability is subject to supplier stock. AWiiDA cannot guarantee that a product remains available until paid for and confirmed by the supplier.
The client must check all dimensions, colours, materials, finishes and care instructions before approving or purchasing products.
Furniture and décor may have natural variations, handmade differences, wood grain differences, texture variation, minor irregularities or finish differences, especially where products are handmade, natural, imported, woven, carved, dyed, painted or produced in batches.
Unless defective, décor and furniture items ordered specifically for a client may not be returned if the client changes their mind, the item does not fit due to incorrect client measurements, or the client later changes the design direction.
19. Online Shop Terms
Online shop purchases are subject to product availability, payment confirmation, delivery availability and these Terms and Conditions.
AWiiDA may cancel and refund an online order if:
The product is out of stock;
The supplier discontinued the product;
The listed price was incorrect due to an obvious error;
The delivery address is outside available delivery areas;
Payment fails or is reversed;
The order appears fraudulent;
AWiiDA cannot reasonably fulfil the order.
AWiiDA will take reasonable steps to display product descriptions, pricing, delivery terms, returns information and other legally required information for electronic transactions. The ECTA requires suppliers offering goods or services online to make certain information available, including supplier details, product characteristics, full price, payment manner, delivery timing, return policy, security procedures and consumer rights where applicable.
The client is responsible for ensuring that all online order details are correct before checkout, including product, quantity, colour, size, delivery address, contact details and billing information.
20. Online Cooling-Off Rights
Where the ECTA applies to an online transaction, a consumer may have the right to cancel certain electronic transactions without reason within seven days after receipt of goods or within seven days after conclusion of a service agreement. The only charge that may be levied is the direct cost of returning the goods, and qualifying refunds must be processed within 30 days after cancellation.
However, this cooling-off right does not apply to all transactions. It does not apply, among other exceptions, to goods made to the consumer’s specifications, clearly personalised goods, goods that by their nature cannot be returned, or services that began with the consumer’s consent before the end of the seven-day period.
Accordingly, unless otherwise required by law, the seven-day online cooling-off right does not apply to:
Custom-made curtains;
Made-to-measure blinds;
Roman blinds;
Shutters made to order;
Custom tracks or rods;
Cut fabric;
Cut wallpaper;
Special-order wallpaper;
Custom upholstery;
Furniture ordered for a specific client;
Personalised or altered goods;
Goods installed, affixed, altered or used;
Services already started with the client’s consent.
21. Delivery
Delivery may be performed by AWiiDA, a courier, supplier, installer, transport contractor or logistics provider.
Delivery timeframes are estimates unless expressly guaranteed in writing. Timeframes may be affected by supplier stock, manufacturing delays, courier delays, import delays, public holidays, weather, strikes, road conditions, load shedding, supplier errors, payment delays, access issues, or events outside AWiiDA’s reasonable control.
The client must ensure that:
The delivery address is correct;
A responsible person is available to receive goods;
The site is accessible;
Delivery vehicles can access the premises where necessary;
Any access restrictions are disclosed in advance;
Stairs, lifts, gates, estate access and parking requirements are disclosed;
Goods can physically fit through doors, staircases, lifts, passages and entrances.
If delivery fails due to incorrect details, absence, access problems or client delay, AWiiDA may charge additional delivery, storage, courier or handling fees.
Risk in goods passes to the client on delivery, collection or installation handover, except where the law provides otherwise.
The client or authorised representative must inspect goods on delivery where reasonably possible and note visible damage, missing items or packaging damage immediately.
22. Collection by Client
Where the client collects goods from AWiiDA or a supplier, the client is responsible for ensuring that the goods are safely loaded, transported and protected.
AWiiDA is not responsible for damage caused after collection by the client, the client’s courier, the client’s contractor or any unauthorised third party.
Collected goods must be inspected before leaving the collection point where reasonably possible.
23. Installation
Installation dates are scheduled subject to product availability, payment status, installer availability, site readiness and agreed project requirements.
The client must ensure that the installation site is ready, safe and accessible. This includes:
Clear access to installation areas;
Removal of fragile items;
Removal of furniture where required;
Safe working conditions;
Access to electricity where required;
Disclosure of hidden pipes, wiring or structural issues;
Disclosure of wall type, ceiling type and previous installation problems;
Permission from landlords, body corporates, managing agents or property owners where required.
AWiiDA and its installers may refuse or postpone installation if the site is unsafe, inaccessible, not ready, not structurally suitable, affected by damp, under construction, or otherwise not suitable for installation.
Additional charges may apply for:
Extra installation visits;
Waiting time;
After-hours installation;
Difficult access;
High ceilings;
Special equipment;
Scaffolding;
Removal of old fittings;
Site not ready;
Incorrect client information;
Additional drilling, repairs or modifications;
Travel outside the agreed area.
AWiiDA is not responsible for damage caused by hidden wiring, hidden pipes, weak plaster, brittle tiles, hollow walls, poor construction, old fixtures, unstable surfaces, damp, previous poor workmanship or undisclosed site conditions.
24. Client-Supplied Products
If AWiiDA agrees to install, hang, style or work with client-supplied products, this is done at AWiiDA’s discretion.
AWiiDA is not responsible for defects, shortages, incorrect sizes, missing parts, poor quality, supplier warranties, installation incompatibility, inaccurate instructions or performance failures relating to client-supplied products.
If client-supplied goods are unsuitable, unsafe or defective, AWiiDA may refuse installation and may charge for time, travel or attempted installation.
25. Project Management and Supplier Coordination
Where AWiiDA provides project management or supplier coordination, AWiiDA will take reasonable steps to coordinate the agreed interior-related scope.
Project management does not make AWiiDA liable for every act, omission, delay, defect, warranty issue or failure of third-party suppliers, manufacturers, couriers, installers, contractors or service providers, unless required by law or expressly agreed in writing.
AWiiDA may assist with communication, scheduling, ordering, supplier follow-up, installation planning and styling, but supplier lead times, stock availability, manufacturing quality, courier timing and third-party performance remain subject to supplier processes and terms.
Where third-party issues arise, AWiiDA will take reasonable steps to assist the client, but AWiiDA cannot guarantee supplier outcomes beyond applicable legal rights and supplier warranties.
26. Design Work, Moodboards, Layouts and Concepts
Design work, concepts, moodboards, 2D layouts, product recommendations, room concepts and styling suggestions are creative and advisory services.
Unless expressly agreed in writing, they are not architectural drawings, engineering plans, construction documents, municipal plans, technical building plans or guaranteed visual representations of the final result.
Colours, textures, proportions and finishes shown in concepts, moodboards or digital presentations are indicative only and may differ in real life.
The client is responsible for reviewing and approving all designs, selections, products, measurements, quantities and finishes before ordering.
Design revisions beyond the included scope may be charged separately.
27. Home Staging and Property Styling
Home staging and property styling may include temporary or permanent décor, furniture, soft furnishings, layout changes, styling and presentation guidance.
Where items are hired, loaned or temporarily placed, the client is responsible for protecting them from damage, theft, loss, stains, pets, children, weather, misuse and unauthorised movement.
The client will be liable for repair or replacement costs of damaged, lost or stolen hired or loaned items.
AWiiDA does not guarantee that staging will result in a property sale, rental, higher selling price, faster sale, booking increase or specific financial result.
28. Guesthouse, Hospitality and Commercial Projects
Hospitality, guesthouse, office and commercial projects may be subject to heavier use than private residential spaces.
The client must disclose the intended use of the space so AWiiDA can recommend suitable products where possible.
Unless expressly warranted in writing, products supplied for residential use may not be suitable for heavy commercial use, guesthouse turnover, high traffic areas, restaurants, offices, hospitality environments or public-facing spaces.
The client is responsible for ensuring compliance with any industry-specific requirements, health and safety requirements, fire safety requirements, building regulations, insurance requirements or hospitality regulations applicable to their premises.
29. Returns, Refunds and Exchanges
Returns, refunds and exchanges are handled according to South African law, supplier policies, product type and these Terms and Conditions.
AWiiDA will not accept returns for change of mind on:
Custom-made goods;
Special-order goods;
Made-to-measure goods;
Personalised goods;
Cut fabric;
Cut wallpaper;
Installed goods;
Used goods;
Damaged goods;
Altered goods;
Clearance items;
Sale items marked final sale;
Products ordered specifically for the client;
Products no longer in original condition or packaging.
This does not affect the client’s rights where goods are defective, unsafe or not as agreed.
Where goods are eligible for return, they must be returned unused, undamaged, uninstalled, clean, complete, in original packaging, with all accessories and proof of purchase.
AWiiDA may inspect returned goods before approving any refund, repair, exchange or replacement.
Refunds may exclude delivery fees, return courier fees, installation fees, design fees, consultation fees, handling fees, supplier restocking fees or costs already incurred, unless the law requires otherwise.
Under CPA section 20, certain return rights may not apply where goods have been partially or entirely disassembled, physically altered, permanently installed, affixed, attached, joined or added to property.
30. Defective Goods and Consumer Warranty Rights
AWiiDA respects lawful consumer warranty rights.
Under the CPA, goods supplied to a consumer carry an implied warranty of quality. If goods fail to meet the required standards within six months after delivery, the consumer may return the goods without penalty and at the supplier’s risk and expense, and the supplier must, at the consumer’s direction, repair, replace or refund the defective goods.
This warranty does not apply where the issue was caused by:
Misuse;
Abuse;
Neglect;
Normal wear and tear;
Incorrect installation by someone other than AWiiDA or its appointed installer;
Unauthorised repairs or alterations;
Failure to follow care instructions;
Incorrect cleaning;
Water damage;
Damp;
Mould;
Sun fading;
Power surges;
Pet damage;
Child damage;
Accidental damage;
Commercial overuse;
Environmental conditions;
Structural defects;
Damage after delivery;
Alteration contrary to supplier instructions.
If AWiiDA or a supplier repairs defective goods and the same defect is not remedied or a further defect is discovered within three months after the repair, the CPA may require replacement or refund of the goods.
31. Supplier Warranties
Many products supplied by AWiiDA are manufactured or imported by third-party suppliers. These products may be covered by supplier-specific warranties.
Supplier warranties may differ depending on the product, brand, supplier, manufacturer, material, mechanism, fabric, finish or intended use.
Supplier warranties may cover certain defects in materials or workmanship but may exclude wear and tear, fading, misuse, incorrect cleaning, incorrect installation, environmental damage, commercial use, moisture damage, rust, power faults, batteries, motors, remotes, fabric behaviour or damage caused after delivery.
Where a supplier warranty applies:
The warranty is subject to that supplier’s terms;
The client must provide proof of purchase;
The product may need to be inspected;
The supplier may decide whether to repair, replace, refund or reject the claim;
Warranty outcomes may take time due to supplier processes;
AWiiDA will assist with reasonable supplier communication but cannot create a warranty beyond what the supplier or law provides.
AWiiDA does not warrant supplier products beyond applicable law and any written warranty expressly provided by AWiiDA or the supplier.
32. Installation Workmanship Warranty
Where AWiiDA provides installation through its appointed installers, AWiiDA will take reasonable steps to ensure that installation is performed with due care and skill.
Installation workmanship issues must be reported in writing as soon as possible and preferably within 7 calendar days after installation.
AWiiDA will assess reported workmanship issues and, where AWiiDA confirms that the issue resulted from its installation workmanship, AWiiDA may repair or correct the issue within a reasonable time.
The installation workmanship warranty does not cover:
Movement of walls, ceilings or floors;
Weak plaster;
Damp or water damage;
Client-supplied products;
Misuse;
Tampering;
Unauthorised removal or reinstallation;
Third-party repairs;
Building defects;
Hidden pipes or wiring;
Incorrect client instructions;
Normal settling of fabric;
Product defects covered by supplier warranties;
Issues not reported within a reasonable time.
33. Care, Maintenance and Use
The client is responsible for following all product care and maintenance instructions provided by AWiiDA, the supplier, the manufacturer or the product label.
This may include instructions for cleaning, vacuuming, spot cleaning, dry cleaning, steaming, washing, dusting, operation of blinds, motor use, curtain handling, wallpaper cleaning, upholstery protection and exposure to sunlight.
Failure to follow care instructions may void warranties and may result in damage for which AWiiDA is not liable.
34. Cancellations by the Client
Cancellation rights depend on the type of order, stage of work, product type and applicable law.
For non-custom services or bookings, AWiiDA may charge a reasonable cancellation fee depending on:
The nature of the goods or services;
The notice given;
Work already performed;
Products already ordered;
Supplier commitments;
Manufacturing already started;
Installation slots reserved;
Travel already incurred;
The possibility of reallocating the booking;
Industry practice.
The CPA allows suppliers to require a reasonable deposit and impose a reasonable cancellation charge for advance bookings, reservations or orders, subject to fairness considerations, and excludes special-order goods from this cancellation section.
For custom-made goods, special-order goods or supplier-order goods, cancellation may not be possible once the order has been placed, materials have been cut, products have been ordered, manufacturing has started or supplier commitments have been made.
35. Cancellations by AWiiDA Interiors
AWiiDA may cancel or suspend an order, service or project if:
The client fails to pay;
The client provides false or incomplete information;
The client is abusive, threatening or unreasonable;
The site is unsafe;
The product is unavailable;
A supplier cancels or discontinues the product;
The project becomes impossible or commercially impractical;
The client repeatedly delays decisions;
The client refuses required approvals;
The client changes the scope materially;
A force majeure event occurs;
AWiiDA cannot lawfully or safely complete the work.
Where AWiiDA cancels due to supplier unavailability or inability to perform, AWiiDA will refund amounts paid for undelivered goods or unperformed services, subject to lawful deductions for work already completed, goods already supplied, custom goods already ordered, and costs already incurred where permitted by law.
Under the ECTA, if an online supplier cannot perform because goods or services are unavailable, the supplier must notify the consumer and refund payments within 30 days after that notification.
36. Changes to Scope
Any change to the agreed scope must be recorded and approved.
Changes may affect:
Pricing;
Supplier availability;
Lead times;
Manufacturing;
Installation dates;
Delivery fees;
Design fees;
Project management fees;
Quantities;
Warranty terms;
Final appearance.
AWiiDA is not required to perform extra work unless the client approves the additional quotation and payment terms.
37. Lead Times and Delays
Lead times are estimates and may vary depending on supplier stock, manufacturing, import timelines, courier services, installation availability, site readiness and payment timing.
AWiiDA is not liable for delays caused by:
Supplier delays;
Manufacturing delays;
Shipping delays;
Courier delays;
Import delays;
Customs delays;
Load shedding;
Weather;
Strikes;
Public holidays;
Client delays;
Late payments;
Late approvals;
Access issues;
Incorrect information;
Force majeure events.
AWiiDA will communicate material delays where reasonably possible. Delay does not automatically entitle the client to cancel custom-made or special-order goods unless the law requires otherwise.
38. Approvals
The client must approve all relevant details before AWiiDA proceeds. Approval may be given by signature, email, WhatsApp, payment of deposit, online checkout, verbal instruction followed by confirmation, or any other recorded instruction.
The client’s approval confirms acceptance of:
Product selections;
Fabric selections;
Wallpaper selections;
Colours;
Finishes;
Measurements where applicable;
Quantities;
Pricing;
Room allocation;
Installation address;
Project scope;
Lead times;
Supplier terms;
These Terms and Conditions.
Once approved, changes may result in additional costs and may not be possible if ordering or manufacturing has begun.
39. Storage
If the client fails to accept delivery, delays installation, delays collection or postpones a project after goods are ready, AWiiDA may charge storage fees.
AWiiDA will take reasonable care of stored goods but is not liable for extended storage risks beyond its reasonable control.
If goods remain uncollected or undeliverable for more than 60 days after written notice, AWiiDA may take lawful steps to recover storage costs, cancel the order, resell non-custom goods where possible, or pursue any lawful remedy available.
Custom-made goods remain payable by the client.
40. Risk and Ownership
Ownership of goods remains with AWiiDA until paid in full.
Risk in goods passes to the client when goods are delivered, collected, installed, handed over or placed under the client’s control, except where the law provides otherwise.
The client may not withhold payment for delivered or installed goods because of unrelated disputes, minor snagging items or issues affecting only part of the order.
41. Snagging and Handover
After installation or project completion, the client must inspect the work and report any visible snagging items as soon as reasonably possible, preferably within 7 calendar days.
Snagging does not include changes of mind, new scope, ordinary product tolerances, natural variations, supplier variations, fabric behaviour, site defects or damage caused after handover.
AWiiDA will assess valid snagging items and arrange correction where appropriate.
If the client or a third party interferes with the installation, removes products, attempts repairs or alters the work before AWiiDA has inspected it, AWiiDA may reject the snagging claim.
42. Limitations of Liability
To the fullest extent permitted by South African law, AWiiDA will not be liable for:
Indirect loss;
Consequential loss;
Loss of profit;
Loss of income;
Loss of business;
Loss of bookings;
Loss of opportunity;
Emotional distress;
Inconvenience;
Third-party claims;
Loss caused by supplier delay;
Loss caused by client delay;
Loss caused by incorrect client information;
Loss caused by site conditions;
Loss caused by unauthorised third-party work.
AWiiDA’s liability, where legally permitted, is limited to the amount paid by the client for the specific defective product or service giving rise to the claim.
Nothing in this clause limits liability where South African law does not allow liability to be limited.
43. Indemnity
The client indemnifies AWiiDA against claims, damages, losses, costs and expenses arising from:
Incorrect information supplied by the client;
Incorrect measurements supplied by the client;
Unsafe site conditions;
Undisclosed defects;
Unauthorised instructions from the client’s representatives;
Client-supplied products;
Third-party contractors appointed by the client;
Misuse of goods;
Failure to follow care instructions;
Changes made by the client or third parties;
Access issues;
Damage caused after delivery or installation;
Breach of these Terms and Conditions.
44. Force Majeure
AWiiDA will not be liable for failure or delay caused by events beyond its reasonable control, including but not limited to:
Acts of God;
Fire;
Flood;
Storm;
Pandemic;
Epidemic;
War;
Civil unrest;
Strikes;
Supplier shutdowns;
Import delays;
Transport delays;
Load shedding;
Power failures;
Government restrictions;
Natural disasters;
Material shortages;
Currency fluctuations;
System failures;
Any event outside AWiiDA’s reasonable control.
AWiiDA will take reasonable steps to continue or reschedule performance where possible.
45. Intellectual Property
All website content, images, copy, layouts, designs, moodboards, concepts, drawings, product arrangements, branding, service descriptions, photographs, project documents and creative work created by AWiiDA remain the intellectual property of AWiiDA or its licensors unless otherwise agreed in writing.
The client may not copy, reproduce, distribute, publish, sell, alter or use AWiiDA’s intellectual property without written permission.
Payment for a design service does not transfer copyright unless expressly stated in writing.
AWiiDA may use project photographs, before-and-after images, room images, design images or completed project images for marketing, portfolio, website and social media purposes unless the client objects in writing before publication. AWiiDA will take reasonable care not to publish private personal information without consent.
46. Photography and Marketing
AWiiDA may request permission to photograph completed work. Where permission is granted, AWiiDA may use those images for marketing, social media, website, portfolio, brochures, advertising and promotional material.
If the client does not want images used, the client must notify AWiiDA in writing.
AWiiDA will not intentionally disclose confidential client information, exact addresses or sensitive personal information in marketing material without consent.
47. Privacy and Personal Information
AWiiDA processes personal information according to its Privacy Policy and applicable data protection laws.
Personal information may be used for enquiries, quotations, orders, payments, deliveries, installations, customer service, project communication, marketing where permitted, legal compliance and business administration.
By using AWiiDA’s website or services, the client agrees that AWiiDA may process personal information as reasonably required to provide goods and services.
48. Complaints and Dispute Resolution
Clients must raise complaints in writing by emailing info@awiidainteriors.co.za with:
Full name;
Contact details;
Invoice or order number;
Description of the issue;
Photographs where applicable;
Date of delivery or installation;
Requested resolution.
AWiiDA will investigate complaints and respond within a reasonable time.
The client must allow AWiiDA a reasonable opportunity to inspect, repair, replace, correct or resolve the issue before pursuing further remedies, where allowed by law.
If a dispute cannot be resolved internally, the parties may use mediation, legal processes, the Consumer Goods and Services Ombud where applicable, the National Consumer Commission where applicable, or any other competent authority.
49. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of South Africa.
The parties consent to the jurisdiction of the courts of South Africa for any dispute arising from these Terms and Conditions, subject to any consumer rights or statutory dispute mechanisms that may apply.

AWiiDA may send notices to the client using the email address, telephone number, WhatsApp number, physical address or billing details supplied by the client.
The client is responsible for keeping contact details updated.
51. Amendments to These Terms
AWiiDA may update these Terms and Conditions from time to time.
The version published on the website at the time of the transaction will generally apply to that transaction, unless otherwise agreed or required by law.
Continued use of the website or services after changes are published means the client accepts the updated Terms and Conditions.
52. Entire Agreement
These Terms and Conditions, together with any quotation, invoice, written project agreement, approved scope, privacy policy, returns policy and written supplier terms where applicable, form the entire agreement between AWiiDA and the client.
If there is a conflict between these Terms and a specific written quotation or project agreement, the specific written quotation or project agreement will apply only to the extent of that conflict.
Product and Service-Specific Conditions
The following additional conditions apply to specific product and service categories.
53. Mini-Reno Room Refresh
A Mini-Reno Room Refresh may include re-use of existing furniture, layout changes, décor updates, soft furnishings, fixtures, curtains, rugs, wall finishes, styling and selected product sourcing.
AWiiDA does not guarantee that existing furniture will become like new. Existing pieces may have wear, marks, structural weaknesses, fabric fading, scratches or limitations.
The client accepts that a mini-reno is not a structural renovation unless expressly agreed in writing.
Building work, electrical work, plumbing work, painting, repairs and contractor work are excluded unless specifically included.
54. Interior Design Consultation
Interior design consultations provide guidance and recommendations. They do not guarantee that every recommendation will be available, affordable, suitable for all site conditions or accepted by the client.
Implementation of advice is at the client’s discretion unless AWiiDA is appointed to supply, manage or install the recommended items.
55. Custom-Made Curtains
Custom-made curtains are made according to selected fabric, lining, heading style, measurements, fullness, track or rod requirements and approved specifications.
Curtains may require settling time after installation. Minor movement, folds, creasing, pattern placement variation and fabric behaviour are normal.
Curtains exposed to sunlight may fade over time. Lining and fabric performance depends on supplier quality, fabric composition, care and environmental conditions.
56. Roman Blinds and Soft Furnishings
Roman blinds are fabric-based products and may show fold lines, slight movement, fabric relaxation or pattern behaviour.
Soft furnishings, scatter cushions, throws, bed runners and fabric accessories may vary according to fabric repeat, cut, piping, trim and filling.
57. Blinds and Shutters
Blinds and shutters may have tolerances, light gaps and operational characteristics depending on the product type, window shape, mounting method and supplier specifications.
Wooden, PVC, aluminium and composite products may expand, contract or react to temperature, moisture and sunlight.
58. Motorised Blinds and Curtain Tracks
Motorised products may require electrical preparation, programming, remote controls, batteries, Wi-Fi connectivity, apps or smart-home compatibility.
AWiiDA is not responsible for internet failure, Wi-Fi instability, app updates, power failures, electrical faults, power surges, smart-home incompatibility, battery neglect or user programming errors.
Electrical work must be performed by a qualified electrician unless otherwise agreed.
59. Wallpaper
Wallpaper results depend heavily on wall condition, preparation, wallpaper quality, adhesive suitability, humidity and installation environment.
AWiiDA is not responsible for wallpaper lifting, bubbling, staining, mould, seam visibility or failure caused by damp, poor wall preparation, moisture, structural movement, incorrect cleaning or environmental conditions.
60. Upholstery
Re-upholstery results are affected by the structure of the existing furniture. AWiiDA does not guarantee the internal condition of old furniture unless repairs are quoted and performed.
Fabric selection must suit the intended use. Performance fabrics may still stain, wear or fade if misused or incorrectly cleaned.
61. Furniture and Décor Sourcing
AWiiDA may recommend furniture and décor based on style, size, budget and availability, but final approval remains with the client.
The client must ensure that sourced furniture can fit through entrances, staircases, lifts and the intended room.
Returns may not be possible for supplier-order goods, custom furniture or items ordered specifically for the client.
62. Office Furniture and Workspace Interiors
AWiiDA may assist with office furniture, reception areas, consulting rooms and workspace interiors. AWiiDA does not provide occupational health, ergonomic certification, building compliance, electrical certification or fire compliance unless expressly agreed in writing through qualified professionals.
Commercial clients must ensure compliance with all workplace, safety, insurance and building requirements.
63. Rugs, Mirrors, Wall Art and Décor Styling
Rugs may vary in colour, weave, pile, texture, shedding and size tolerance.
Mirrors and wall art require suitable wall fixings. The client must disclose wall type and hidden services. AWiiDA is not liable for wall failure caused by weak walls, poor plaster, hidden defects or unsuitable surfaces.
Décor styling is subjective. AWiiDA will provide professional guidance, but personal preference remains the client’s responsibility.
64. Bedroom Styling, Linen and Soft Finishes
Bed linen, pillows, throws, scatters, headboards and bedroom accessories are subject to supplier availability and care instructions.
Items used, washed, slept on, stained, marked or removed from original packaging may not be returnable unless defective.
65. Curtain Tracks, Rods and Accessories
Tracks, rods, brackets, rings, finials, tiebacks and accessories must be suited to the curtain weight, wall type, mounting method and intended use.
AWiiDA is not responsible for failure caused by weak walls, overloaded rods, forceful use, tampering, incorrect use, unauthorised reinstallation or undisclosed structural issues.
66. Installation and Final Styling
Final styling may include placing furniture, décor, rugs, lamps, cushions, throws, wall art and accessories.
AWiiDA is not responsible for fragile, valuable or sentimental items unless damage is caused by AWiiDA’s proven negligence. Clients should remove valuables before installation or styling.
67. Project Management for Interior Updates
AWiiDA’s project management is limited to the agreed interior scope. It does not include construction project management, building contractor supervision, architectural oversight or statutory compliance unless expressly agreed.
AWiiDA is not liable for independent contractors appointed directly by the client.
68. Guesthouse and Hospitality Interiors
Hospitality interiors experience heavier use. The client must inform AWiiDA where products will be used in guest rooms, public areas, breakfast areas, reception areas or high-use environments.
Supplier warranties may be limited where goods are used commercially.
69. 2D Layouts, Moodboards and Room Concepts
2D layouts and moodboards are planning tools and visual guides. They are not construction drawings and must not be used for building, electrical, plumbing or structural work.
Dimensions are indicative unless verified through technical measurement.
70. Home Staging and Property Styling
Home staging is intended to improve presentation but does not guarantee sale, rental, valuation, buyer interest, booking performance or price.
The client remains responsible for property condition, cleaning, maintenance, security and access during staging.
Final Acceptance Clause
By using the AWiiDA Interiors website, submitting an enquiry, approving a quotation, paying a deposit, placing an order, accepting delivery, allowing installation, or using any AWiiDA product or service, the client confirms that they have read, understood and accepted these Terms and Conditions.
